The warning letter the fine depends on
A Utah HOA cannot fine an owner without a written warning first — one that describes the violation, cites the exact governing-document provision, and (for an ongoing violation) gives at least 48 hours to cure. Skip an element and the fine that follows isn't authorized. This tool produces a warning with every statutory element in place.
[Community name] Written warning — governing document violation Dear [Owner name], This letter is a written warning under Utah Code § 57-8a-208. No fine has been assessed. Description of the violation: [Describe the violation — what, where, and when it was observed] Provision violated: This conduct violates [Governing-document provision, e.g. CC&Rs § 7.2] of the association's governing documents. Because this is a continuing violation, Utah Code § 57-8a-208(2)(a)(iv) requires the association to give you a reasonable time to cure. Please cure the violation on or before September 26, 2026. If the violation is cured by that date, no fine will be assessed. If a fine is assessed after this warning, you will have the right under Utah Code § 57-8a-208(4) to request an informal hearing before the board within 30 days of the fine notice. No interest or late fees accrue on a fine while a timely requested hearing is pending, and a final decision may be appealed to the courts within 180 days. The board would rather resolve this than fine anyone. If you believe this notice was sent in error, or there are circumstances the board should know about, reply and we will review it.
