What the declaration says
Can the board raise dues? The board adopts the annual budget and sets annual assessments from it; the declaration states no percentage cap and gives owners no vote on the budget. Owners must get written notice of the annual assessment 15 to 60 days before the start of the calendar year, and at least 15 days before any change in the amount takes effect. During the period of declarant control the declarant alone sets all annual, special, and individual assessments.Section 6.04 · p. 13
What dues and fees does the declaration set?The 2026 declaration sets no dollar amount for annual dues, but it does set fees: an initial reinvestment fee on transfer of $1,000 or 0.5% of the unit's value, whichever is less; a $25 charge for a certificate of payment status; and a $50 account payoff fee if not otherwise set by rule. Delinquent accounts are charged a $25 late fee each month plus 18% annual interest.Section 6.14.1 · p. 14
What happens over unpaid dues?Payments are delinquent if received more than 10 days after they are due, and then carry a $25 monthly late fee and interest at 18% per year, plus collection costs and attorney fees. Unpaid amounts are a lien on the unit that the association can enforce by judicial or nonjudicial foreclosure after at least 30 days' written notice. The board may also suspend voting rights and common area use, cut off utilities paid as a common expense after 3 business days' notice, and collect rent directly from a tenant once an assessment is more than 60 days late.Section 7.02 · p. 15
What insurance does the HOA carry, and who pays the deductible? The association may carry a blanket property policy on the project and buildings (it is not required to insure fixtures or building components) and must carry general liability of at least $1,000,000, directors and officers coverage, and workers' compensation as required by law. The association's policy does not cover owners' personal property or personal liability, and owners must insure their own property. When a loss is covered by both policies the association's is primary and the owner pays the association's deductible in proportion to the damage to the owner's unit; if unpaid within 30 days after repairs are complete it becomes an individual assessment.Section 10.02.3 · p. 22
Does the declaration require a reserve fund? The association must maintain an adequate reserve fund for maintenance, repair, and replacement of the common area, in an amount determined by the board, and reserves may be collected as part of the annual assessments. Surplus funds may be kept as additional reserves. During the period of declarant control the declarant has no duty to obtain a reserve analysis or fund reserves.Section 5.11 · p. 10
What can't owners do with their homes?Signs may only be put up, including in windows, with the board's prior written approval, and no temporary structures such as tents or shacks are allowed without board approval. No noxious, illegal, or offensive activity or nuisance is permitted, rubbish may not accumulate outside a unit, and units may not be split or subdivided. Owners may not store or release hazardous substances except small quantities normal to maintenance.Section 9.03 · p. 19
Do I need approval to change my home's exterior? No exterior change may be made without the board's prior written approval, and the board may dictate design, color, style, model, and manufacturer. Interior structural changes, such as moving or adding walls, doorways, or overhead doors, also need prior written board approval and the board may require an engineering report. External items like antennas, satellite dishes, fences, awnings, lighting, and exterior doors also require approval.Section 9.10 · p. 20
What about pets and parking?Vehicles may not be parked so as to block a unit entrance, overhead doors, or impair vehicular access or snow removal. The board may adopt parking rules covering time limits, fees for common area stalls, vehicle size and type, and towing, and may allocate parking spaces equally among units while keeping the legally required guest and handicap spaces.Section 9.06 · p. 19
Can the association fine owners?Yes. The board may adopt a schedule of fines and levy them for violations, and may also terminate utility services paid as a common expense, cut off common area access, suspend voting rights, and sue. The board may create a hearing process but is not required to offer one except as required by law, and it controls the procedure and final decisions.Section 5.09 · p. 10
How is the board chosen, and when does the developer step back? After declarant control ends, the board has 3 to 7 unit-owner members elected by the owners to staggered two-year terms, with elections at each annual meeting; any number of owners present in person or by proxy is a quorum. During the period of declarant control the declarant appoints and removes all board members or acts as the board. That period ends at the earliest of three years after the first unit deed is recorded, six months after more than three-fourths of the undivided interests are conveyed, or the declarant's recorded written waiver.Section 1.20 · p. 4
How do the CC&Rs change?During the period of declarant control the declarant may amend the declaration and plat alone, and no other amendment is valid without the declarant's written consent while it owns a unit. After all declarant units are sold and declarant control ends, owners holding at least 60% of the undivided interests may amend, effective when recorded with the Utah County Recorder. Declarant and the association may also make unilateral corrective or legally required amendments, and the declarant rights and dispute resolution articles have their own longer consent restrictions.Section 15.02 · p. 28

Questions about Athens Industrial Commercial HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Athens Industrial Commercial's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Athens Industrial Commercial HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

Waiting on the boardOnly the board can answer this

What does Athens Industrial Commercial HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Athens Industrial Commercial HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Athens Industrial Commercial restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Athens Industrial Commercial HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Athens Industrial Commercial — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

Waiting on the boardOnly the board can answer this

What does Athens Industrial Commercial's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
