What the declaration says
Can the board raise dues? The maximum annual assessment may be raised each year by up to 10% over the prior year's maximum without further approval; a larger increase requires approval of 67% of the board. If the board proposes to raise the annual assessment more than 25% above the prior year, it may instead levy a special assessment, which must be approved by two-thirds of the votes of each class of members present at a meeting called for that purpose.Section 8.3(b) and 8.4 · p. 23
What dues and fees does the declaration set?In 2009 the declaration set the maximum annual assessment at $960 per lot, payable at $80 per month. Unpaid amounts carry 12% annual interest and a late fee of up to $25 per month (or 10% of the assessment, whichever is greater), the association may charge up to $15 for a payoff certificate, and the architectural committee may charge a processing fee of up to $50. A one-time $2,000 special assessment per lot or unit was levied to build the clubhouse and pool.Section 8.3(a) · p. 23
What happens over unpaid dues?Assessments are a continuing lien on the lot and the owner's personal obligation, with 12% annual interest, costs and attorney fees. Any amount unpaid 15 days after the due date is delinquent and subject to a late charge of up to $25 per month or 10% of the assessment, whichever is greater, and the association may sue the owner or foreclose the lien like a mortgage. The association may also suspend voting rights and common area use for up to 60 days after notice and a hearing for rule violations.Section 8.9 · p. 25
What insurance does the HOA carry, and who pays the deductible? The association may carry fire and hazard insurance on common area improvements at full replacement cost, public liability coverage of at least $500,000 per occurrence, workers' compensation if required, and a fidelity bond covering those handling association funds. Each owner of an improved lot must separately maintain fire and extended coverage insurance equal to at least 100% of the replacement value of the improvements on the lot. The declaration does not address deductibles.Section 9.1 · p. 27
Does the declaration require a reserve fund? The association must establish and maintain a reserve fund for repairs and replacement of the common area, funded by monthly allocations in an amount set from time to time by the board. The board may also create other reserves it considers necessary.Section 8.13 · p. 25
Can owners rent their homes? All leases must be in writing with a minimum term of one year, must state they are subject to this declaration, and must list the association as an additional insured. Owners who do not live on their lot must give the association current contact information, and failing to provide a copy of the lease may bring a recurring fine. Owners must also prohibit smoking in their leases and are liable for fines caused by their tenants.Section 2.19 · p. 12
What can't owners do with their homes?Lots are for single-family residential use only; a home office is allowed only if the operator lives there, has no more than one non-resident employee, uses no more than 33.3% of the floor area, and has architectural committee approval. Smoking inside a unit or on the common areas is strictly prohibited as a nuisance. Swimming pools are banned, no fence or wall may be built beyond those installed by the developer or builder, and trailers, boats, campers and recreational vehicles must be kept in off-site storage.Section 2.3 · p. 8
Do I need approval to change my home's exterior? No structure or exterior alteration may be built or changed until plans are approved in writing first by the master Community Association design review committee and then by the Architectural Review Committee, which has at least three members. If the committee fails to approve or disapprove plans within 60 days of receipt, they are deemed approved. Approved work must start within six months and finish within twelve months of starting, and a processing fee of up to $50 may be charged.Section 2.2(c) · p. 7
What about pets and parking? No more than two domestic animals may be kept in a unit, dogs must be on a hand-held leash outside, owners must clean up after their pets, and no breeding or boarding is allowed. Trailers, buses, tractors and recreational vehicles may not be parked or stored on lots, streets or common areas, and vehicles may not be parked in driveways except when entering or exiting the garage.Section 2.23 · p. 13
Can the association fine owners?Owners are fined for smoking violations under a fine schedule adopted by the board, and a recurring fine may be imposed for failing to provide a copy of a lease. The association may also suspend voting and common area rights for up to 60 days after notice and a hearing, and may sue at law or in equity with the violator responsible for court costs and attorney fees.Section 2.25(b) · p. 14
How is the board chosen, and when does the developer step back? The association is managed by a board of three directors; at the first annual meeting members elect one director each for three-, two- and one-year terms, and thereafter directors serve three-year terms. Class B (declarant and builder) membership, which carries three votes per lot, ends on the earlier of July 1, 2016 or when Class A votes equal or exceed Class B votes, and the developer must transfer control after 90% of the units have been conveyed to Class A members.Section 4.3 · p. 16
How do the CC&Rs change? While Class B membership exists, an amendment needs the vote or written consent of at least two-thirds of the Class A members plus Declarant "A", signed by association officers; after Class B membership lapses, two-thirds of Class A members approving at a duly called meeting is enough. Amendments must be recorded with the Utah County Recorder and take effect on recording, and provisions on Eagle Mountain City design standards and utility rights-of-way cannot be changed without the city's written consent.Section 11.9 · p. 30

Questions about Heatherwood Cottages HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Heatherwood Cottages's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Heatherwood Cottages HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Heatherwood Cottages HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Heatherwood Cottages HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Heatherwood Cottages restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Heatherwood Cottages HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Heatherwood Cottages — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Heatherwood Cottages's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
