From the Utah Department of Commerce HOA registry, July 31, 2026. Why the expiry matters: under § 57-8a-105 a lapsed association can't enforce assessment liens — how Utah assessment liens work.

What the declaration says
Can the board raise dues? The board sets annual assessments by adopting a budget, and no percentage cap or owner vote on the budget is stated. Owners must get written notice at least 15 days before any change in the annual assessment amount takes effect. Special assessments totaling more than $2,000 in a calendar year must be approved by a majority of owners present in person or by proxy at a meeting called for that purpose.Section 5.4 · p. 10
What dues and fees does the declaration set?The 2025 declaration states no dollar figure for annual dues; they are each lot's equal share of the budget. It does set a $25.00 late fee each month on delinquent accounts, 18% annual interest on unpaid balances, and a $50.00 fee for providing payoff information. A reinvestment fee is payable by the buyer on transfer, in an amount the board sets up to the maximum allowed by law.Section 5.15 · p. 12
What happens over unpaid dues?Payments are delinquent if received more than 10 days after the due date, and then carry a $25 monthly late fee and 18% annual interest. The association has a lien on the lot that may be foreclosed judicially or non-judicially through a power of sale, after at least 30 days' written notice, and it may sue for a money judgment, collect rent from tenants, suspend voting rights, and cut off common-area use and association-paid utilities. Collection costs and attorney fees are added to the account.Section 5.16 · p. 12
What insurance does the HOA carry, and who pays the deductible? The association carries a blanket "all in" property policy at 100% of replacement cost on the common areas and attached living units, including interior fixtures, floor coverings, cabinets, paint and windows, plus at least $1,000,000/$2,000,000 general liability and $1,000,000 directors and officers coverage. When a loss involves a living unit or its limited common area, the owner pays the association's deductible in proportion to the damage attributable to the unit, and the association may assess it if unpaid within 30 days of repairs. Owners must insure their own personal property and liability and are advised to carry an HO6 policy covering at least the association's deductible.Section 8.2 · p. 19
Does the declaration require a reserve fund? The board must establish a reserve account to fund long-term maintenance of common areas. It must follow any statutory requirement to conduct a reserve analysis and use it in deciding how to fund reserves. Board members are not personally liable for failing to fund reserves absent proven willful or intentional misconduct.Section 5.18 · p. 13
Can owners rent their homes?Leasing is permitted, but an owner may not lease individual rooms or less than the entire living unit, and leases must require tenants to follow the governing documents. Short-term and vacation rentals are allowed but for no less than one week. An owner renting for initial terms under 30 days must use a licensed professional rental management company providing 24-hour service and a 24-hour tenant assistance phone number, and occupancy is limited to two people per bedroom.Section 9.9 (a) · p. 25
What can't owners do with their homes? Each lot may be used only as a single-family residence; businesses need board consent unless the activity is invisible from outside, draws no visitors or traffic, and does not raise insurance costs. Recreational, commercial, and oversized vehicles must be parked outside the project except for loading and unloading, and damaged vehicles may not sit visible in driveways. Smoking is banned on all common and limited common areas, window air conditioners and swamp coolers are prohibited, and garbage cans and outdoor gear must be kept out of view.Section 9.2 · p. 23
Do I need approval to change my home's exterior? No landscaping, grading, excavation, building, fence, wall, structure, or alteration of any kind may be started until plans and specifications are approved in writing by the board. The board may adopt design guidelines setting materials, colors, styles, and landscaping requirements, and may grant written variances signed by all board members. No decision deadline or deemed-approval rule is stated.Section 10.1 · p. 26
What about pets and parking?Owners may keep no more than two domestic pets, which may not become a nuisance (loose animals, excessive barking, fouling, or threatening behavior), and owners must immediately clean up pet waste. Parking is prohibited in guest stalls by non-guests, in red zones or fire lanes, where it blocks snow removal or access, and in driveways shorter than 18 feet; the association may fine, boot, or tow violators.Section 9.6 · p. 24
Can the association fine owners?Yes. The association may assess fines against owners, occupants, and guests for violations of the governing documents, and they are jointly and severally liable for them. It may also take remedial action, enter a lot to correct violations and bill the cost as an individual assessment, record a notice of noncompliance, and sue; the prevailing party in enforcement actions recovers court costs and reasonable attorney fees.Section 11.2 · p. 27
How is the board chosen, and when does the developer step back? The board has three members, who must be owners or an owner's spouse and are elected by the owners to staggered two-year terms, with at least one seat up each year. Owners hold an annual meeting set by the board, and any number of owners present in person or by proxy constitutes a quorum. The declaration contains no declarant control provision; the association itself adopted this restated declaration.Section 4.2 · p. 43
How do the CC&Rs change?Owners may amend the declaration and plat by the affirmative vote of at least 67% of the association's voting interests, with no meeting needed if consents or ballots are collected; amendments take effect when recorded with the Wasatch County Recorder. The board may amend unilaterally to comply with law, satisfy a government agency, or fix scrivener's errors. Challenges to an amendment must be brought within six months of recording.Section 13.1 · p. 28

Questions about Black Rock Ridge HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Black Rock Ridge's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Black Rock Ridge HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Black Rock Ridge HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Black Rock Ridge HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Black Rock Ridge restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Black Rock Ridge HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Black Rock Ridge — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Black Rock Ridge's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
