What the declaration says
Can the board raise dues? The association cannot set dues on its own. Every assessment, annual or special, must be approved by a majority vote of all lot owners at an annual meeting or a special meeting called for that purpose. No percentage cap is stated.Section 2.4 · p. 6
What happens over unpaid dues?Unpaid assessments plus interest become a lien on the lot, and the association may record a notice of lien once payment is delinquent and foreclose it like a trust deed or mortgage. The owner must pay collection costs, court costs, reasonable attorney fees, and assessments that come due during foreclosure, and the association may seek a receiver to collect rents. A buyer of a lot is jointly and severally liable with the seller for unpaid assessments.Section 2.5 · p. 7
Can owners rent their homes?Owners or their authorized agents may rent or lease their residential building from time to time. Any rental must be for residential, not commercial, use. No cap, minimum lease term, or approval requirement is stated.Section 3.17(b) · p. 14
What can't owners do with their homes?Lots are for single-family residential use only, buildings may not exceed 20 feet average height above grade, and dwellings must have at least 2,000 square feet on the ground level if single story or 1,800 if multi-story, excluding garage, carport and patio. A-frame, geodesic dome, Mediterranean and Southwestern adobe styles are prohibited, as are wood shake and wood shingle roofs. Storage buildings, garbage containers and air conditioning equipment must be at the rear of the dwelling, out of view from the street.Section 3.4 · p. 8
Do I need approval to change my home's exterior?Yes. No building, fence, wall, structure, exterior addition or alteration, excavation, tree or shrub removal, or landscaping is allowed without a written application and two sets of plans approved by the Architectural Committee. If the committee fails to approve or disapprove a design and location within 30 days after plans are submitted, approval is not required.Section 5.6 · p. 18
What about pets and parking?Owners may keep no more than one animal per acre, counting the lot size minus one acre for the dwelling and outbuildings and rounding fractions down, and never more than 15 animals regardless of lot size. Household pets under 15 pounds are exempt from that limit, and no animals may be kept for economic gain or boarded for hire. Parking on streets is prohibited, and campers, trailers, motor homes and commercial vehicles must be stored inside buildings or behind the dwelling out of sight from the street.Section 3.12 · p. 12
Can the association fine owners? The declaration does not provide for fines. The declarant, the Architectural Committee, or any owner may enforce the covenants by proceedings at law or in equity, and any violation is declared a nuisance subject to every remedy allowed by law or equity. Separately, the association may enter a lot to remove a violating improvement and assess the owner the actual cost of enforcement plus 10 percent for administrative costs, secured by a lien.Section 7.1 · p. 20
How is the board chosen, and when does the developer step back?Owners other than the declarant are Class A members with one vote per lot; the declarant is the Class B member with three votes per lot. Class B membership ends and the declarant becomes a Class A member when fee title to 39 of the 51 original lots has been conveyed to purchasers, or 15 years after the declarant first conveys a lot, whichever happens first. The Board of Trustees appoints the Architectural Committee, which must have at least three members.Article II, Voting Rights · p. 6
How do the CC&Rs change? The covenants may be amended or repealed by recording a written instrument executed by a vote of a majority of the association's members. No amendment may eliminate or change the declarant's rights without the declarant's written consent, and an amendment does not bind an existing mortgagee or trust deed beneficiary unless it joins in the amendment.Section 7.4 · p. 20

Questions about Greenerhills HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Greenerhills's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Greenerhills HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Greenerhills HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Greenerhills HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Greenerhills restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Greenerhills HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Greenerhills — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Greenerhills's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
