From the Utah Department of Commerce HOA registry, July 31, 2026. Why the expiry matters: under § 57-8a-105 a lapsed association can't enforce assessment liens — how Utah assessment liens work.

What the declaration says
Can the board raise dues? The Board of Trustees sets the annual assessment from a proposed budget sent to members by August 1 each year. Any increase in the per-lot annual assessment must be recommended by the board and approved by a majority of the votes of members present in person or by proxy at a meeting called for that purpose, with 10 to 30 days' written notice.Section 5.c · p. 5
What dues and fees does the declaration set?The 1999 declaration sets no dollar amount for dues; the board determines the annual assessment, with the first one due September 1, 1999. It does set a late fee of 5% of the amount owing and interest of 18% per year on delinquent assessments.Section 5.h · p. 7
What happens over unpaid dues?Unpaid assessments are a continuing lien on the lot and the owner's personal obligation. If not paid within 15 days after becoming delinquent, a 5% late fee applies plus 18% annual interest, and the HOA may sue the owner or foreclose the lien, recovering attorneys' fees and costs; a Notice of Lien must be recorded and mailed at least 30 days before suit. Owners and occupants of a delinquent lot lose the use of the common areas.Section 5.h · p. 7
What insurance does the HOA carry, and who pays the deductible?Assessments may be used to pay taxes and insurance on the common areas. The committee may also obtain fidelity bond coverage for anyone handling HOA funds. The declaration says nothing about insuring homes or about deductibles.Section 5.b · p. 5
Does the declaration require a reserve fund?Assessments may be used to establish and fund a reserve for major repairs of improvements within the common areas. The declaration states the intent that assessments be adequate to provide sufficient reserves to maintain and replace common area improvements at comparable quality.Section 5.b · p. 5
What can't owners do with their homes?Lots may be used only for residential purposes, with one detached single-family home and a private garage for no more than two vehicles. No trailer, tent, shack or other outbuilding may be used as a temporary or permanent residence, and no signs may be shown to public view except name plates and one sale or lease sign of up to four square feet.Section 3 · p. 2
Do I need approval to change my home's exterior?Yes. No building, wall or fence over six feet, or other structure may be placed on a lot, and no material change to a home's exterior may be made, without the Architectural Control Committee's written approval. Complete plans and specifications must be submitted at least 14 business days before the proposed construction start date, and the committee may refuse any design it finds unsuitable.Section 7.b · p. 8
What about pets and parking?A reasonable number of household pets is allowed under Heber City ordinances as long as they are not a nuisance and leash laws are obeyed; livestock and poultry, and buildings to house them, are prohibited. Campers, boats, trailers and similar vehicles may not sit in driveways more than 10 days and must be stored in a garage or behind a fence; commercial vehicles over three-quarters of a ton must be kept in an enclosed garage and may not be parked overnight on subdivision streets.Section 12.b · p. 9
Can the association fine owners? The declaration does not provide for fines. Declarant or any lot owner may sue at law or in equity to force compliance, stop a violation and recover damages, and a successful party may recover costs and reasonable attorney's fees from the violator.Section 17 · p. 12
How is the board chosen, and when does the developer step back? The subdivision is run by a three-member Architectural Control Committee that can act by any two members. Declarant controls the committee and fills vacancies for as long as it owns any lots, and may allow earlier election by owners. Once Declarant owns no lots, committee members may be removed, replaced or elected by majority vote of owners at a meeting where owners of at least 51% of the lots are present; at the first annual meeting three members are elected for one-year terms.Section 4.c · p. 3
How do the CC&Rs change? The covenants run until January 1, 2025 and then renew automatically for successive 10-year periods. They may be amended or released by a vote of at least two-thirds of the then owners of the lots, through a written agreement specifying the changes and filed with the Heber City Recorder.Section 2 · p. 2

Questions about Heber Landing HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Heber Landing's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Heber Landing HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Heber Landing HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Heber Landing HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Heber Landing restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Heber Landing HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Heber Landing — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Heber Landing's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
