What the declaration says
Can the board raise dues? The board sets the annual assessment each year from a budget it prepares, and no percentage cap is stated. If the board decides during the year that budgeted funds are inadequate, it may increase the assessment for that fiscal year effective on a date it designates.Section 6.2.4 · p. 32
What dues and fees does the declaration set?The 2014 declaration sets no dollar figure for the annual assessment; the board sets it from the budget, and may charge a reasonable transfer fee it sets. The attached bylaws state unpaid assessments bear 18% interest per year, allow a late charge of at least $25.00 or 10% of the delinquent assessment, and require a new owner to pay $100.00 to the association within 30 days of a title transfer.Bylaws Section 5.03 · p. 71
What happens over unpaid dues?Any assessment unpaid 30 days after it is due bears interest at a rate the board sets, and the board may add a late fee. The association has a lien on the unit, perfected by recording of the declaration, and may sue the owner, foreclose the lien judicially or nonjudicially after 30 days' written notice, collect the tenant's lease payments if an owner is more than 60 days late, and recover interest, lien fees, court costs and attorney fees.Section 6.9 · p. 34
What insurance does the HOA carry, and who pays the deductible? The association must carry fire and casualty insurance at 100% of replacement cost covering the units and owner-installed interior items such as floor coverings, cabinets, light, electrical, heating and plumbing fixtures, paint, wall coverings and windows, plus property insurance on common areas, general liability of at least $1,000,000, workers' compensation, fidelity bonding and errors and omissions coverage. Owners must carry at least $10,000 of Coverage A building insurance, and owner insurance is primary for items the owner must maintain. An owner whose unit is damaged pays a share of the association's deductible based on that unit's damage percentage, and the association may assess and lien the amount if it is not paid within 30 days after repairs are substantially complete.Section 8.1 · p. 44
Does the declaration require a reserve fund?Annual assessments may include an adequate contingency reserve, a major maintenance reserve or sinking fund, and a reserve fund for maintenance, repairs and periodic replacement of common areas. Two separate funds must be created and maintained, one for operating expenses and one for capital expenses. The bylaws also allow a reserve analysis assessment on a two-thirds vote of owners.Section 6.2.1 · p. 32
Can owners rent their homes?Owners or their agents may rent or lease their dwelling unit for use as overnight accommodations, subject to any association rules governing rentals. No unit may be sold under a timeshare, interval ownership, fractional or club program without approval, though the declarant reserves the right to create such a program.Section 3.3.4 · p. 17
What can't owners do with their homes?Units are for residential living only and no part of the project may be used for commercial or business purposes. No trailers (other than boat trailers), mobile homes, tractors, truck campers or trucks other than pickups may be kept on the property, though boats and their trailers may be parked in private driveways subject to board rules. Signs are banned unless approved in writing, and clotheslines, above-ground tanks and woodpiles are prohibited.Section 3.3.4 · p. 17
Do I need approval to change my home's exterior? No work that alters the exterior appearance of a unit, including color changes, landscaping, grading or excavation, may be done without prior written approval of the declarant or the Oak Edition Design Review Committee, which may withhold approval for any reason. A written request detailing the work must be submitted, and the committee may charge a reasonable review fee payable when the application is filed.Section 3.5 · p. 21
What about pets and parking? No more than two ordinary household pets may be kept in a unit or common area, subject to local pet and leash ordinances and board rules, and the board may require removal of a pet that is undisciplined or an undue annoyance or danger. Parking is allowed only in areas approved by the declarant or the design review committee, and no vehicles, campers or trailers may be stored on the project.Section 3.3.6 · p. 17
Can the association fine owners? The declaration does not provide for fines. Violations may be enforced by the association or any owner as a private nuisance, with costs and reasonable attorney fees to the prevailing party, and the association may record a notice of violation. It may also suspend an owner's use of common areas and recreational facilities for up to 60 days per infraction (and for successive 60-day periods if uncorrected) or while assessments are delinquent, and may do corrective maintenance work at the owner's cost if a violation is not cured within 14 days.Section 12.1 · p. 51
How is the board chosen, and when does the developer step back? The association is run by a three-member board elected by the members at the annual meeting, held the first Wednesday of March, with a quorum of a majority of owners. The declarant holds Class B membership with three votes per unit it owns, and its approval is required for amendments as long as it owns any unit.Bylaws Section 7.02 · p. 75
How do the CC&Rs change? An amendment requires members casting at least 67% of the total votes (one vote per unit), and is made by recording a certificate of amendment signed on behalf of the association. While the declarant owns any unit, the declaration may be amended or terminated only with the declarant's written approval, and the declarant may amend unilaterally in certain cases such as legal compliance or while its Class B membership exists.Section 11.2 · p. 50

Questions about Village Shores Building HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Village Shores Building's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Village Shores Building HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Village Shores Building HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Village Shores Building HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Village Shores Building restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Village Shores Building HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Village Shores Building — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Village Shores Building's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
