From the Utah Department of Commerce HOA registry, July 31, 2026. Why the expiry matters: under § 57-8a-105 a lapsed association can't enforce assessment liens — how Utah assessment liens work.

What the declaration says
Can the board raise dues? The board prepares and adopts the annual budget and sets the annual assessment; the declaration states no percentage or CPI cap. Owners must receive written notice at least 15 days before any change in the annual assessment takes effect. Owners may not disapprove a budget during the period of declarant control.Section 5.5 · p. 10
What dues and fees does the declaration set?The 2022 declaration sets no dollar annual or monthly assessment amount. It does set a $25.00 late fee each month on delinquent accounts, 18% annual interest on unpaid balances, and a $50.00 fee for payoff information at sale or refinance. Special assessments over $2,000 in a calendar year must be approved by a majority of members present at a meeting, though the declarant may levy any amount during declarant control.Section 5.15 · p. 12
What happens over unpaid dues?Payments are delinquent if received more than 10 days after the due date, and they accrue a $25 monthly late fee plus 18% interest. The association has a lien on the lot that may be foreclosed judicially or non-judicially after at least 30 days' written notice, and it may sue for a money judgment, suspend voting rights, cut off utilities paid from common expenses, and bar use of the common areas.Section 5.16 · p. 12
What insurance does the HOA carry, and who pays the deductible? The association carries property insurance on the entire project including the common area and all buildings, but it excludes owner fixtures, improvements and betterments such as floor coverings, cabinets, fixtures, paint and wall coverings. The owner is responsible for the association's deductible on the portion of a covered loss attributable to that owner's unit, and the association may assess the owner if it is not paid within 30 days of repairs. The association also carries at least $1,000,000 of general liability coverage and directors' and officers' coverage; each owner must insure their own personal and real property.Section 8.2 · p. 18
Does the declaration require a reserve fund? The board must establish a reserve account to fund long-term maintenance of the common areas, with the amount left to the board's sole discretion. The declarant has no duty to obtain a reserve analysis or fund reserves during the period of declarant control.Section 5.18 · p. 12
Can owners rent their homes?Leasing of units is permitted. The board may adopt rules on leasing, such as requiring a copy of each lease and tenant contact information, and all leases must require the tenant to follow the governing documents. An owner has 10 days after written notice to cure a tenant's violation or nuisance, after which the board may begin eviction proceedings on the owner's behalf.Section 9.9 · p. 21
What can't owners do with their homes?Units may be used only for commercial or retail purposes; no residential use is allowed. Boats, trailers, motorhomes and RVs may not be parked in the project for more than four hours, and no observable outdoor storage is permitted outside units. Signs and external fixtures such as satellite dishes, fences, awnings and lighting need prior written board approval.Section 9.1 · p. 20
Do I need approval to change my home's exterior? No landscaping, grading, excavation, building, fence, wall, other structure or alteration of any kind may be started until construction plans and specifications are approved in writing by the architectural control committee. The board may appoint a three-member committee and acts as the committee until one is appointed; the declarant serves as the committee during the period of declarant control. No decision deadline or deemed-approval rule is stated.Section 10.2 · p. 23
What about pets and parking?Animals are prohibited from being bred or kept within the project. Vehicles may not be parked so as to block a unit entrance, along the private roads, or anywhere that impairs vehicle or pedestrian access or snow removal; common area stalls are for vehicle parking only and may be assigned and regulated by the board.Section 9.8 · p. 21
Can the association fine owners? The association may assess fines against owners, occupants and their guests for violations of the governing documents, and owners and occupants are jointly and severally liable for them. The association, declarant or any owner may also sue at law or in equity to enforce the documents, and the prevailing party recovers court costs and reasonable attorney fees.Section 11.2 · p. 24
How is the board chosen, and when does the developer step back? The board has three members, who must be owners or an owner's spouse. During the period of declarant control the declarant appoints the board and sets their terms; afterward owners elect directors by secret ballot to staggered two-year terms, with at least one seat up each year at the annual meeting. Declarant control ends six months after all lots and additional land are conveyed to others, or when the declarant records a written waiver.Section 4.2 · p. 41
How do the CC&Rs change? While the declarant owns a lot or any additional land, the declarant alone may amend the declaration and plat, and no other amendment is valid without the declarant's written consent. After declarant control ends and all declarant lots are sold, amendments require an affirmative vote of at least 67% of the voting interests. Amendments take effect when recorded with the Wasatch County Recorder, and the declarant-rights and dispute-resolution articles have added consent restrictions.Section 15.2 · p. 28

Questions about Wasatch Springs Commercial

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Wasatch Springs Commercial's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Wasatch Springs Commercial HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Wasatch Springs Commercial HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Wasatch Springs Commercial HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Wasatch Springs Commercial restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Wasatch Springs Commercial HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Wasatch Springs Commercial — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Wasatch Springs Commercial's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
