What the declaration says
Can the board raise dues? The board sets dues each year: it mails a proposed budget to owners by November 1 and adopts the budget and the annual assessment at a meeting held by December 15, no earlier than 14 days after the notice. The declaration states no percentage cap on increases and gives owners no vote or veto over the budget; expenses are split equally per lot.Article IX, Section C.1–C.2 · p. 15
What dues and fees does the declaration set?The declaration does not state a dollar amount for annual dues. It does set, as of the 2010 recording, a $300 plan review fee for each new residence, a $1,000 deposit against road damage during construction (unless Midway City requires a bond), and a fee of up to $10 for a written statement of account.Article II (Architectural and Landscape Committee), Section 2(d) · p. 6
What happens over unpaid dues?Unpaid installments bear interest at 1.5% per month plus a late penalty of $1.00 per day until paid. The association has a lien on the lot for assessments, penalties, interest and attorney's fees, may record a notice of lien once payment is delinquent, and may foreclose like a mortgage or sue the owner personally for the debt plus costs and attorney's fees.Article IX, Section E (Lien for Assessments) · p. 17
Does the declaration require a reserve fund?Association expenses payable from assessments may include funds for a contingency reserve and funds reserved for maintenance, repair and replacement of the common areas and common facilities. The declaration sets no required funding level and does not mention a reserve study.Article II, Definition 2 (Association Expenses) · p. 3
What can't owners do with their homes? Each lot may hold only one detached single-family residence, with outbuildings allowed only if approved by the committee and not used for habitation. Open storage of building materials, boats, campers, trailers and trucks larger than pick-ups is treated as prohibited unsightliness, and signs are limited to the name and address on a mailbox plus temporary 48-inch by 48-inch for-sale or election signs. Carports are prohibited, and no heating oil, propane or other bulk fuel storage is allowed except temporarily during construction.Article V, Sections 1, 6, 9 and 15 · p. 7
Do I need approval to change my home's exterior?Plans and specifications for building or meaningfully altering any improvement must be submitted to the Architectural and Landscape Committee at least 30 days before construction and approved in writing. The committee reviews within 30 days of a complete submittal and payment of the review fee; if it does not act in that time the submission is deemed disapproved. The committee ceases to exist when all residences and landscaping are complete or five years from the declaration, whichever comes first, and its duties pass to the association.Article II (Architectural and Landscape Committee), Sections 2, 2(f) and 4 · p. 4
What about pets and parking?Only household pets may be kept, and animal ownership must follow city guidelines. Permanent and overnight parking on project streets and common areas is not allowed, short-term street parking is limited to one side of the street, and no vehicle, trailer, boat, RV or snowmobile may stand in the development more than two days unless fully enclosed in a garage or behind a fenced area at the back of the lot.Article VII, Sections D, E and F · p. 13
Can the association fine owners? The association may adopt reasonable rules and regulations that include fines or penalties for violations, and may bring court action to compel compliance or recover fines, penalties or damages. The declarant, the association or any owner may enforce the covenants at law or in equity, and the prevailing party recovers costs and attorney's fees. The declaration does not describe a notice-and-hearing procedure for fines.Article VII, Section H (Rules and Regulations) · p. 14
How is the board chosen, and when does the developer step back?A board of directors runs the association, and the declarant has the exclusive right to appoint and remove all directors until 75% of the lots in all phases are sold. After that, owners elect the board under the articles, bylaws and Utah nonprofit law. Each lot has one vote.Article VII, Sections C and D · p. 13
How do the CC&Rs change?Until March 2013 the declaration could be amended only by a written document signed by the developer and recorded with the Wasatch County Recorder. After that date it may be amended by a vote of the owners of a majority of the lots. The common-area maintenance section may not be amended or deleted without Midway City's approval.Article XII, Section 3 · p. 18

Questions about Burgi Hill Ranches HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Burgi Hill Ranches's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Burgi Hill Ranches HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Burgi Hill Ranches HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Burgi Hill Ranches HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Burgi Hill Ranches restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Burgi Hill Ranches HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Burgi Hill Ranches — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Burgi Hill Ranches's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
