From the Utah Department of Commerce HOA registry, July 31, 2026. Why the expiry matters: under § 57-8a-105 a lapsed association can't enforce assessment liens — how Utah assessment liens work.

What the declaration says
Can the board raise dues? The board adopts the annual budget each year. If the new budget is more than 15% higher than the prior year's budget, it must be approved by more than 50% of the owners present in person or by proxy at a meeting called for that purpose. Owners get at least 15 days' written notice before any change in the annual assessment amount takes effect.Section 6.1 · p. 12
What dues and fees does the declaration set?The 2023 declaration does not state a dollar amount for annual dues; they are set by the budget and billed quarterly. It does set a $25 late fee per month on delinquent accounts, 18% annual interest on unpaid balances, a $25 fee for an assessment status certificate, and a $50 account payoff fee. The board may levy special assessments up to $500 per lot per calendar year on its own; more than that needs owner approval.Section 6.15 · p. 14
What happens over unpaid dues?Payments are delinquent if received more than 15 days after the due date, and unpaid amounts become a lien on the lot and the owner's personal obligation. The association may charge a $25 monthly late fee plus 18% interest, suspend voting rights and common area use, terminate utilities paid as a common expense, collect rent directly from a tenant, sue for a money judgment, and foreclose the lien judicially or non-judicially after at least 30 days' written notice.Section 6.16 · p. 14
What insurance does the HOA carry, and who pays the deductible? The association carries a blanket property policy on the common areas at 100% of replacement cost, at least $1,000,000 in general liability coverage, and directors and officers liability coverage; it may also buy theft/embezzlement and workers' compensation coverage. The policies do not cover living units, owners' personal property, or owners' personal liability, and owners are required to insure those themselves. The association must set aside an amount equal to its property insurance deductible, or at least $10,000 if the deductible is higher.Section 8.2 · p. 17
Does the declaration require a reserve fund?Yes. The board must establish a reserve account to fund long-term maintenance and replacement of the common areas, follow any statutory reserve analysis requirement, and use that analysis in deciding how to fund the account.Section 6.18 · p. 15
Can owners rent their homes? An owner who buys after this declaration was recorded must live in the lot as a primary residence for the first 12 months before renting, with exceptions for military deployment, family occupancy, job relocation of two years or less, and certain entity or estate-planning ownership. All leases must be in writing for an initial term of at least six months; daily, weekly, Airbnb-style and other short-term or seasonal rentals are prohibited. A copy of the lease must be given to the association, and owners may not rent individual rooms or less than the whole lot.Section 9.1 · p. 20
What can't owners do with their homes?Lots are limited to single-family residential use; a business needs written association consent unless it is invisible from outside, draws no outside visitors, and does not raise insurance costs. Boats, trailers, recreational vehicles, large trucks and commercial vehicles may not be parked in the project for more than 72 hours unless in a board-designated storage area. No signs other than "For Sale" or "For Lease" may be placed on a lot without board permission, and garbage must be kept in covered containers out of sight.Section 9.6 · p. 22
Do I need approval to change my home's exterior?Yes. No building, addition, landscaping change, or exterior alteration, repainting, or refurbishing may be done until complete plans have been submitted to and approved by the Architectural Control Committee (the board acts as the committee if none is appointed). Design criteria require wood siding, stucco or stone exteriors, limit roofing materials, and require ACC consent for fencing, patio privacy enclosures, metal awnings and grading changes. Exterior construction must be finished within one year of starting.Section 10.3 · p. 26
What about pets and parking?Only household pets are allowed; they must be leashed or caged when off the lot, may not be bred commercially, and may not create noise or other nuisance. No outdoor structure for housing or confining pets is allowed, and violators may be fined.Section 9.5 · p. 22
Can the association fine owners?Yes. The board may enforce the governing documents by fine or by legal or equitable action, and may recover court costs and reasonable attorney fees, which can be charged to the owner as an individual assessment even if no lawsuit is filed. Occupants, guests and invitees are jointly and severally liable with the owner for fines caused by their conduct.Section 11.1 · p. 26
How is the board chosen, and when does the developer step back? The board has three, five or seven members, who must be owners or an owner's spouse, at least 18, and in good standing. Members are elected by owner vote to staggered three-year terms and may serve only two consecutive terms. Owners present in person or by proxy at a properly called meeting constitute a quorum, and a majority of board members is a quorum for board action.Section 4.2 · p. 41
How do the CC&Rs change? The declaration may be amended by more than 50% of the voting interests present in person or by proxy at a meeting called for that purpose where a quorum is present, with 7 to 30 days' notice. Quorum at the first meeting is 60% of the total votes; if that fails, a later meeting needs half that quorum. Amendments take effect when recorded with the Wasatch County Recorder, with the president certifying the vote.Section 13.1 · p. 27

Questions about Colonies Valais HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Colonies Valais's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Colonies Valais HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Colonies Valais HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Colonies Valais HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Colonies Valais restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Colonies Valais HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Colonies Valais — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Colonies Valais's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
