From the Utah Department of Commerce HOA registry, July 31, 2026. Why the expiry matters: under § 57-8a-105 a lapsed association can't enforce assessment liens — how Utah assessment liens work.

What the declaration says
Can the board raise dues? The maximum annual assessment was $1,200 per unit until January 1 of the year after the first unit was sold. After that the maximum may be increased by no more than 15% above the prior year's maximum each year; a larger increase requires the same owner vote needed to amend the declaration.Section 16.6 · p. 38
What dues and fees does the declaration set?In 2000 the declaration set the maximum annual assessment at $1,200 per unit, payable in twelve monthly installments or in four quarterly installments. Each buyer (other than the declarant) must prepay at closing a sum equal to three monthly installments of the annual assessment. Unpaid monthly assessments bear 12% annual interest if not paid within 15 days, and special assessments bear 12% if not paid within 30 days.Section 16.6 · p. 38
What happens over unpaid dues?Unpaid assessments plus interest and collection costs are secured by a lien on the unit once a notice of lien is recorded, and the lien may be foreclosed like a mortgage. The owner must pay the costs of foreclosure, filing the lien, and reasonable attorney's fees, and remains personally liable in a separate suit for money judgment. The Management Committee may also suspend an owner's voting rights for noncompliance.Section 16.8 · p. 39
What insurance does the HOA carry, and who pays the deductible? The Management Committee must carry fire and casualty insurance with extended coverage for the full replacement value of the entire project, excluding the contents of units, plus a fidelity bond for anyone handling association funds. Liability coverage must be at least $300,000 per person injured, $1,000,000 for all persons in one accident, and $1,000,000 for property damage. Owners may buy their own additional insurance at their expense, so long as it does not reduce what the association's policy pays.Section 11.1.1 · p. 28
Does the declaration require a reserve fund? The annual assessment budget must include creation of a reasonable contingency reserve and a surplus or sinking fund, along with maintenance, operating, legal and accounting costs. The Time Period Association's board also estimates capital contributions each year that may include amounts for working capital and a general operating reserve.Section 16.2 · p. 37
Can owners rent their homes? An owner may lease his unit if the lease is in writing, signed by owner and tenant, and states that it is subject to this declaration. No owner may lease less than the entire unit. Time period owners who rent or lease must file a copy of the agreement with the board or manager and are responsible for their tenants' conduct.Section 10.2 · p. 27
What can't owners do with their homes? No livestock or poultry may be raised, bred, or kept in a unit or the common areas, except guide animals. Nothing may be stored or kept on the common areas without the Management Committee's written consent, and no noxious or offensive activity or nuisance is allowed. Nothing may be done that would cancel or increase the rate of the project's insurance.Section 10.5 · p. 28
Do I need approval to change my home's exterior? No structural alterations to any unit may be made without the prior written consent of the Management Committee. The Management Committee handles all architectural control matters and sets the rules and procedures for submitting plans for proposed construction, alteration, or remodeling.Section 10.7 · p. 28
What about pets and parking?Parking recreational vehicles, boats, or anything other than operational passenger vehicles within the project is prohibited unless approved in writing by the Management Committee. Each unit has two assigned limited common area parking stalls in the first level garage.Section 10.9 · p. 28
Can the association fine owners? The Management Committee may impose assessments against an owner for noncompliance with the rules and regulations, suspend that owner's voting rights, and take judicial action for compliance or damages. Defaulting owners must pay all costs of enforcement, including reasonable attorney's fees. The board may also enter a unit to abate a violating structure or condition at the owner's expense.Section 14.9 · p. 35
How is the board chosen, and when does the developer step back? The Management Committee is three declarant-appointed members until the earlier of 120 days after units representing 75% of the votes are conveyed or seven years after the first unit sale; control then vests in the owners. After that the committee has five to seven members elected to staggered one-, two-, and three-year terms. Annual meetings are held in the first quarter of each year, and a quorum is owners holding a majority of the total votes, present in person or by proxy.Section 14.2 · p. 33
How do the CC&Rs change?Amending the declaration or the survey map requires the vote of at least 60% of the undivided ownership interest in the common areas, and the amendment is recorded by the Management Committee with a certification that the vote occurred. Until units representing 75% of the ownership interest have been sold, the declarant alone may amend. Material amendments also require the prior written approval of 75% of the mortgagees.Section 17.3 · p. 41

Questions about Grindelwald HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Grindelwald's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Grindelwald raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Grindelwald's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Grindelwald fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Grindelwald restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Grindelwald foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Grindelwald — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Grindelwald's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
