What the declaration says
Can the board raise dues? The board prepares and adopts the annual budget each year and sets regular assessments from it, and the declaration states no percentage cap on increases and gives owners no vote on the budget. Owners must get written notice of a regular assessment at least 15 days before the start of the next calendar year and at least 15 days before any change in the amount takes effect.Section 5.4 · p. 11
What dues and fees does the declaration set?The 2026 declaration does not state a dollar amount for annual or monthly dues. It does set a $25 late fee per month on delinquent accounts and 18% annual interest on unpaid balances, and separately a reinvestment fee on transfer equal to three months of regular assessments (Section 5.20) and a $50 account payoff fee (Section 5.21).Section 5.15 · p. 13
What happens over unpaid dues?Payments are delinquent if received more than 10 days after they are due, and a $25 monthly late fee plus 18% annual interest then apply. The association has a lien on the lot that may be foreclosed judicially or non-judicially after at least 30 days' written notice, and it may also sue for a money judgment, suspend voting rights, collect rent from a tenant, and terminate utilities paid from common expenses and use of the common areas.Section 5.16 · p. 13
What insurance does the HOA carry, and who pays the deductible? The association carries a blanket "all in" property policy at 100% of replacement cost covering the common areas and the attached-residence buildings, including fixtures, floor coverings, cabinets, paint, wall coverings and windows, plus at least $2,000,000 comprehensive general liability and directors' and officers' coverage. When a loss is covered by both association and owner policies, the association's policy is primary and the owner is responsible for the association's deductible, allocated by the share of damage attributable to that residence. Owners must insure their own personal property and are advised to carry an HO6 policy covering at least the association's deductible.Section 8.2 · p. 21
Does the declaration require a reserve fund? The board must establish a reserve account to fund long-term maintenance of the common areas and must follow statutory requirements for conducting a reserve analysis and use it in funding decisions. Separate reserves for townhome-lot facilities, if needed, are kept apart from the association's primary reserve fund.Section 5.18 · p. 14
Can owners rent their homes?Leasing is permitted if it complies with Midway City ordinances and the governing documents. Rentals of less than 30 days (transient leasing) must follow Midway City Code Title 7.06, including licensing, inspections, written approval of an adjoining party-wall owner, and a local licensed manager. The board may adopt leasing rules but cannot ban leasing or impose a rental cap without amending the declaration.Section 9.9 · p. 27
What can't owners do with their homes?Boats, trailers, motorhomes, campers, ATVs, snowmobiles and similar recreational vehicles may not be kept in the project except inside an enclosed garage or briefly while loading. No business may be run from a residence without board consent unless only normal residential activity is visible outside. Temporary or prefabricated structures, fireworks, timeshares and fractional ownership are all prohibited.Section 9.4 · p. 25
Do I need approval to change my home's exterior?Yes. No paving, concrete pad, landscaping, grading, building, fence, wall or other improvement or alteration may be started until construction plans and specifications are approved in writing by the board. The board may adopt design guidelines governing materials, style and landscaping, and may grant written variances signed by all board members.Section 10.1 · p. 29
What about pets and parking?Up to two domestic animals may be kept in a residence; chickens, livestock and other farm animals are prohibited, animals must be licensed, leashed or restrained outside, and may not become a nuisance. On parking, owners and occupants must park entirely within their garage or driveway and overnight street parking is prohibited except as the rules allow.Section 9.6 · p. 26
Can the association fine owners?Yes. The association may assess fines for violations of the governing documents, and owners, occupants, guests and family members are jointly and severally liable for them. It may also take remedial action, record a notice of noncompliance, and sue at law or in equity, with the prevailing party entitled to court costs and reasonable attorney fees.Section 11.2 · p. 30
How is the board chosen, and when does the developer step back? The board has three directors, who must be owners or an owner's spouse and at least two of whom must live in the project full time. Directors are elected by owner vote to staggered two-year terms, with at least one seat up each year. The annual meeting is held between September and November, and 30% of voting interests present in person or by proxy is a quorum.Section 4.2 · p. 43
How do the CC&Rs change? The declaration and plat may be amended by the affirmative vote of at least 67% of the voting interests (23 lots), with no meeting required if consents or ballots are used, and the amendment takes effect when recorded with the Wasatch County Recorder. The association may amend unilaterally to comply with law or correct scrivener's errors, and challenges to an amendment must be brought within six months of recording.Section 13.1 · p. 32

Questions about Kantons Village Green HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Kantons Village Green's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Kantons Village Green HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Kantons Village Green HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Kantons Village Green HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Kantons Village Green restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Kantons Village Green HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Kantons Village Green — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

What does Kantons Village Green's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
