What the declaration says
Can the board raise dues? The board may raise the monthly assessment each year by no more than 8% over the prior year's amount without a vote. A larger increase must be approved by at least a majority of the votes of the combined classes of members present in person or by proxy at a meeting called for that purpose, with 10 to 30 days' written notice.Section 5.3 · p. 8
What dues and fees does the declaration set?The 2022 restated declaration carries forward a maximum monthly assessment of $140 per lot set for 2007, which the board may adjust within the limits above. It also sets a $2,000 Common Area Fund Assessment due within 5 days of recording a transfer of a lot, a $15 late fee on payments more than 10 days late, 18% annual interest on delinquencies, a $25 transfer fee filed with the secretary, and a reinvestment fee on sale of up to ½% of the sale price.Section 5.3 · p. 8
What happens over unpaid dues?Unpaid assessments and fines are a continuing lien on the lot and the owner's personal obligation. If not paid within 60 days of becoming delinquent, the amount bears 18% annual interest and the association may sue the owner or foreclose the lien, recovering attorney's fees and costs. The association may also suspend a delinquent owner's voting rights and demand rent directly from a tenant.Section 5.10 · p. 10
What insurance does the HOA carry, and who pays the deductible? The association must carry fire and casualty insurance with extended coverage for the full replacement value of improvements in the common areas, plus liability insurance of at least $500,000 per person injured, $2,000,000 per accident, and $100,000 for property damage. Each owner is responsible for securing homeowners special form coverage (Form 3 or better) on their own home. The declaration does not address deductible allocation.Section 6.5 · p. 14
Does the declaration require a reserve fund?Assessment funds may be used to establish and fund a reserve to cover major repair or replacement of improvements within the common areas. The declaration does not state a required funding level or reserve study.Section 5.2 · p. 8
Can owners rent their homes?Rentals are allowed but the minimum initial lease term is six months; nightly, hostel, dormitory, roommate rentals and subletting are prohibited, as is leasing to a business entity. Owners must use a written lease, give the association a copy with tenant contact information, and run a criminal background and sex offender check on occupants. Violations can draw daily fines and the board may seek to terminate the lease and evict.Section 10.4 · p. 28
What can't owners do with their homes?Lots are limited to single-family residences; no gainful occupation, profession or trade may be conducted, though a home office is allowed. No fencing is permitted on a lot except wrought iron fencing around a swimming pool, and no signs may be posted except legally required signs, construction signs, a For Sale or For Rent sign allowed by the board, and political signs up to 24 by 36 inches for 45 days before an election.Section 7.2 · p. 16
Do I need approval to change my home's exterior? No home, accessory building, addition, landscape change, repainting or exterior refurbishing may be done without prior written approval from the Design Review Committee. Plans must be submitted with a $1,000 review deposit, and the committee must approve or disapprove in writing within 30 days or the submission is deemed approved. A $10,000 compliance deposit is required before construction, and building without approval draws a $100 per day fine.Section 8.4 · p. 24
What about pets and parking? No animals other than household pets are allowed, limited to two dogs and/or cats, and pets must be leashed or caged when off the lot; no breeding for commercial purposes and no nuisance noise. Boats, trailers, snowmobiles, ATVs and recreational vehicles must be kept in a fully enclosed garage, and cars and passenger trucks must be parked on the owner's driveway or in a garage except for temporary parking of up to 24 hours.Section 7.6 · p. 20
Can the association fine owners? The board may levy fines against an owner for violations by the owner, guests, tenants, family or invitees, under a schedule of fines adopted by board resolution; fines are treated as assessments and collectible by lien and foreclosure. An owner may request a hearing in writing within 15 days of a fine, held at the next board meeting. The association may also enter a lot to correct violations and sue for injunctive relief, with attorney's fees to the prevailing party.Section 6.2 · p. 12
How is the board chosen, and when does the developer step back? The association is run by a Board of Trustees elected under the articles and bylaws, and each owner has one vote per lot. The declarant held Class B membership with 10 votes per lot, which ended on the earlier of three months after transfer of the declarant's last lot or December 31, 2017. Quorum for member action is 60% of outstanding votes at the first meeting, dropping to half that at each subsequent meeting.Section 3.2 · p. 5
How do the CC&Rs change?Amendments require the affirmative vote of at least two-thirds of all membership votes at a meeting called for that purpose, with 10 to 30 days' notice, and the written consent of the declarant so long as Class B membership exists. The amendment takes effect when an instrument executed by the president or vice president, certifying the vote, is recorded with the Wasatch County Recorder.Section 10.2 · p. 27

Questions about Cascades Soldier Hollow HOA

10 questions · 8 answered from Utah law · 2 waiting on the board
Answered from Utah lawCommon question · records

How do I get a copy of Cascades Soldier Hollow's CC&Rs?

Put the request in writing. Under § 57-8a-227 the association must make its governing documents available — the latest versions must be free on its website if it has one — and must fulfill a written records request within 10 business days. Emailed copies are free; paper copying charges are capped.

Answered from Utah lawCommon question · dues

How much can Cascades Soldier Hollow HOA raise dues in a year?

Utah sets no statutory cap — the limit, if any, lives in the declaration. § 57-8a-201 requires the board to adopt a budget and give owners notice of the assessment before it takes effect, and in many communities owners can call a meeting to reject the budget.

Answered from Utah lawCommon question · late fees

What happens if I fall behind on dues?

Unpaid assessments become a lien on the home under § 57-8a-301. The association must follow the statute's notice steps before enforcing — and it cannot enforce a lien while its own registration is lapsed.

What does Cascades Soldier Hollow HOA's reserve fund hold right now?

Utah § 57-8a-211 requires a reserve analysis at least every five years and an annual owner vote on funding it. The figure itself lives with the board.

Answered from Utah lawCommon question · fines

Can Cascades Soldier Hollow HOA fine me, and how?

Only for violations of the governing documents, and only with the process Utah law requires: written warning first, a chance to be heard, and fine amounts set by a published schedule. A fine without that process is contestable.

Answered from Utah lawCommon question · rentals

Can Cascades Soldier Hollow restrict rentals?

Often yes, within limits. § 57-8a-209 restricts what rental limits an association can impose and grandfathers owners who were renting before a restriction took effect — the details live in the declaration, so read it alongside the statute.

Answered from Utah lawCommon question · meetings

Can I attend board meetings?

Yes. Under § 57-8a-226 board meetings are open to owners except during executive session, and owners must get notice of meetings. Minutes are records you can request.

Answered from Utah lawCommon question · collections

Can Cascades Soldier Hollow HOA foreclose on my home?

Only at the end of a long, regulated ladder: the debt must be at least 180 days delinquent and the association must first send the certified pre-foreclosure notice § 57-8a-303 requires. Most delinquencies never legally get near foreclosure.

Answered from Utah lawCommon question · buying here

Buying in Cascades Soldier Hollow — what do I get before closing?

The seller can request the association's payoff and document packet, and § 57-8a-106 caps what the association may charge for producing it at $50. Ask for the declaration, bylaws, rules, current budget, and any unpaid assessments on the unit before you commit.

Waiting on the boardOnly the board can answer this

What does Cascades Soldier Hollow's insurance cover, and what's my deductible exposure?

Utah requires the association to carry property and liability coverage and to share policy details with owners on request. What the current policy actually covers — and what falls to owners — is the board's to publish.
